Terms of Use voozaa – Powerbank Rental System

§ 1 Scope & Definitions
1. These terms of use apply to the use of the powerbank rental system under the brand voozaa.
2. The voozaa GmbH is the operator of the technical platform (app, backend, billing system and payment processing), hereafter referred to as “voozaa”.
3. Location Partner is the legally independent company at whose location the powerbank station is operated. This could be voozaa GmbH, one of its subsidiaries, or a franchise partner.
4. User is any natural person who borrows a powerbank via the voozaa system.
5. Subsidiaries within the meaning of these terms of use are the companies in the voozaa group that operate powerbank stations outside Germany. These especially include:
• voozaa Ltd. (United Kingdom)
• Charge Now SL (Spain)
• voozaa Italy S.R.L. (Italy)
• voozaa USA LLC (United States)
§ 2 Contractual Relationship / Rental Agreement
1. The rental agreement for the use of the powerbank is concluded between the user and the respective location partner.
2. voozaa does not become a contracting party of the rental agreement but solely provides the technical rental, billing, and payment system.
3. The location partner merely facilitates the borrowing and return of the powerbank at its location using the voozaa system.
4. For locations in the United Kingdom, Spain, Italy, and the USA, the respective subsidiary of voozaa GmbH acts as the location partner. This subsidiary is named as the contracting partner of the user in the rental process.
§ 3 Services Provided by voozaa
voozaa provides the following services in particular:
• Provision of the mobile app and the backend
• Technical activation and time tracking of the powerbank
• Payment processing via connected payment service providers
• Electronic receipt and payment overview
• Central technical customer support
§ 4 Services Provided by the Location Partner
The location partner is responsible for:
• Providing the physical location
• The accessibility of the powerbank station
• The proper operation of the station on-site
The location partner bears no liability for the technical functioning of the system.
§ 5 Rental Period, Prices & Billing
1. The rental period starts with the withdrawal of the powerbank and ends with its proper return to an official voozaa station.
2. The applicable prices and charges as well as the associated currency are displayed to the user before the contract is concluded on the device or in the app.
3. The invoice is issued in the name of the respective location partner and provided electronically.
4. The rental fee is time-based. Depending on the location, rate, or an ongoing promotion, it is between 1.00 and 2.00 in the respective local currency (e.g., Euro, Pound, or US Dollar) per 20 - 60 minutes. The rate and currency displayed before the rental period begins are decisive.
5. Additionally, a deposit may be charged to secure the return. The deposit is – depending on location and system configuration – between 15.00 and 20.00 in the respective local currency per powerbank and is automatically refunded via the payment method used upon proper return.
§ 5a Maximum Rental Duration / Non-Return
1. The maximum rental period is – depending on the location and rate – between 3 and 5 days.
2. If the powerbank is not returned within the maximum rental period, additional charges (e.g., loss or replacement fees) may be levied according to the conditions displayed before the conclusion of the contract.
§ 6 Payment
1. Payment processing is technically handled via payment service providers integrated by voozaa (e.g., Stripe, PayPal).
2. The payment method is charged after the powerbank is returned or in case of non-return in accordance with the displayed fees.
§ 6a Maximum Overall Charge
The maximum total charge of the payment method used by the user – consisting of rental fees, deposit, and possibly other fees – is between 15.00 and 65.00 in the respective local currency, depending on the rate and location. The total amount displayed before the start of the rental is decisive.
§ 7 Liability
• voozaa is liable for the technical availability and security of the system within the scope of legal regulations.
• The location partner is liable for the proper operation of the location.
• The user is liable for loss, damage, or misuse of the powerbank.
§ 8 Data Protection
The processing of personal data complies with the voozaa GmbH's privacy policy, available at https://voozaa.app/datenschutz
§ 9 Changes to the Terms of Use
voozaa reserves the right to change these terms of use for objective reasons, especially due to technical developments, legal adjustments, or changes in the service offered. The current version is available on the voozaa website.
§ 10 Applicable Law & Jurisdiction
The law of the Federal Republic of Germany applies. The place of jurisdiction is – insofar as legally permissible – Cologne.
§ 11 Severability Clause
Should individual provisions of these terms of use be or become invalid or unenforceable, the validity of the other provisions shall remain unaffected. In place of the invalid provision, the statutory provision shall apply.
